DISTANCE SALES AGREEMENT

This Agreement regulates the rights and obligations of the parties regarding the sale and delivery of the products/services ("Product/Products") that the BUYER (Consumer) wishes to purchase by placing an order on the ABBY GLOBAL TEKSTİL LTD. ŞTİ e-commerce website ("WEBSITE") at https://www.pieroperla.com/, including cases where the BUYER transacts via a mobile application. After the BUYER approves this Agreement on the WEBSITE, the price and expenses of the ordered Product(s) are collected via the chosen payment method.

ARTICLE 2: SUBJECT OF THE AGREEMENT, PRICE, PAYMENT, AND DELIVERY

The type, quantity, brand/model/color, unit price(s), sales value, payment information, and delivery details (including the delivery address provided by the BUYER) of the Products are as follows:

Delivery Terms:

If the cargo company does not have a branch in the BUYER's location, the BUYER must collect the product from a nearby branch notified by the SELLER. If the "Pick up from Piero Perla address" option is selected, the product will be delivered to the selected point within 15 days. The BUYER must collect the product within 14 business days using the code sent via SMS/Email. Failure to collect within this period will be deemed a return, and a refund will be processed.

ARTICLE 3: MATTERS PREVIOUSLY INFORMED TO THE BUYER

The BUYER acknowledges that they have been informed about the following before the establishment of the agreement:

  • The SELLER's identity and contact information.

  • Steps of the sales process and correction of errors.

  • Privacy, data processing, and commercial communication permissions.

  • Total price including taxes, shipping costs, and payment methods.

  • Conditions, duration, and procedures for the Right of Withdrawal.

  • Circumstances where the right of withdrawal is lost or not applicable.

  • Legal remedy methods and contact information for complaints.

ARTICLE 4: RIGHT OF WITHDRAWAL

The BUYER has the right to withdraw from this Agreement within fourteen (14) days from the date of receipt of the Product without giving any justification and without paying any penalty.

Exceptions to the Right of Withdrawal (No Return):

a) Goods prepared according to the BUYER's special requests or personal needs (customized products).

b) Perishable goods or products with an expiration date (e.g., food, cosmetics).

c) Hygiene-sensitive products whose protective elements (seal, package) have been opened (e.g., swimwear, underwear, cosmetics).

d) Goods mixed with other products after delivery that cannot be separated.

e) Digital content, software, or computer consumables whose packaging has been opened.

f) Services whose performance started with the consumer's approval before the withdrawal period expired.

Return Process:

The product must be returned via the SELLER’s contracted cargo company. Returns sent via other companies will not be accepted. The product must be returned in its original box/packaging, undamaged, and in a resalable condition. If the product is damaged due to use not in accordance with technical specifications, the withdrawal request may be rejected or a deduction may be made from the refund.

ARTICLE 5: SPECIAL CONDITIONS FOR REWARD POINTS

5.1. If reward points were earned from the purchase, these points/gifts will be deducted or offset from the refund amount if the order is canceled or returned.

5.2. If the purchase was made using reward points, the refund will be credited back to the BUYER as points (unless otherwise agreed with the point provider).

5.3. In case of unfair point acquisition, the SELLER reserves the right to collect the monetary value from the BUYER.

ARTICLE 6: SECURITY, PRIVACY, AND INTELLECTUAL PROPERTY

6.1. The SELLER takes technical measures for data security, but the BUYER is responsible for protecting their own device against viruses.

6.2. The BUYER consents to the processing and sharing of their data with Abby Global Tekstil for marketing, advertising, and statistical purposes indefinitely or for a period determined by the SELLER.

6.3. The BUYER can stop data processing or commercial communications at any time by contacting the SELLER.

6.4. All intellectual property rights of the WEBSITE belong to the SELLER.

ARTICLE 7: GENERAL PROVISIONS

7.1. Products are delivered within a maximum of 30 days (legally) and typically handed to cargo within 3 business days for in-stock items.

7.2. Unless stated otherwise, shipping costs belong to the BUYER.

7.3. If the BUYER is not present at the address during delivery, the SELLER is deemed to have fulfilled its obligation. Expenses arising from late collection or returns due to the BUYER's absence belong to the BUYER.

7.4. The BUYER must inspect the product upon receipt. If there is damage caused by cargo, they must not accept the product and must have a report (tutanak) filed by the cargo official.

7.5. The BUYER must pay the full price before delivery. If the bank/financial institution cancels the payment after delivery, the BUYER must return the product within 3 days.

ARTICLE 8: LEGAL REMEDIES AND JURISDICTION

In case of disputes, Consumer Arbitration Committees (up to the monetary limits declared by the Ministry of Trade) and Consumer Courts are authorized. The BUYER may apply to the authorities in their place of residence or the SELLER's place of residence. This Agreement is subject to the laws of the Republic of Turkey.
